Niim Beauty Academy (Académie de Beauté Niim) (“Niim,” “we,” “us,” or “our”) provides in-person beauty services and both in-person and online training programs.

1. ACCEPTANCE OF TERMS

1.1 Agreement

Your access to and use of the Site and our services—including beauty services, in-person training, hybrid training, online courses, digital products, workshops, and mentorship (collectively, the “Services”)—are subject to these Terms.

By using the Site or purchasing any Services, you confirm that you have read, understood, and agreed to these Terms.

1.2 Modifications

Niim Beauty Academy reserves the right to modify these Terms at any time. Updates take effect immediately upon posting. Continued use of the Site constitutes acceptance of the revised Terms.

2. USE OF THE WEBSITE

2.1 Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or enroll in training programs.

By using the Site, you represent and warrant that you meet this requirement.

2.2 User Accounts

Where account creation is required, you agree to:

• Provide accurate and complete information

• Maintain the confidentiality of your login credentials

• Accept responsibility for all activity under your account

Niim is not responsible for unauthorized access resulting from your failure to safeguard account information.

3. SERVICES OFFERED

Niim Beauty Academy operates a hybrid beauty and education business.

3.1 Salon Services

We provide professional beauty services including but not limited to:

• Nails

• Brows

• Microshading

• Hairstroke

• Lash lifts

• Manicure and pedicure services

Appointments may be required in advance. By booking, you agree to comply with our booking, deposit, and cancellation policies.

3.2 Training & Educational Programs

Niim offers:

• In-person training

• Hybrid training (online theory plus in-person practice)

• Fully online courses

• Workshops and mentorship

Program details, schedules, and requirements are provided at enrollment and may be updated periodically.

4. BOOKING, PAYMENTS & REFUND POLICY

4.1 Scheduling

Appointments and class registrations must follow the procedures communicated on the Site or by our team.

Niim reserves the right to:

• Reschedule services or classes

• Modify instructors or delivery format

• Cancel sessions when operationally necessary

4.2 Payments

Fees must be paid in full or through an approved payment arrangement. Pricing is subject to change at any time without notice.

4.3 Deposits

Where applicable:

• Deposits are strictly non-refundable

• Deposits secure your appointment or training seat

• No-shows or late cancellations result in deposit forfeiture

4.4 Training & Digital Product Refunds

Due to the limited seating of in-person programs and the immediate access to digital materials:

• Training fees are generally non-refundable

• Online course purchases are final sale

• Access to digital content constitutes full delivery

Any exception is granted solely at Niim’s discretion and must be requested in writing.

5. ONLINE COURSE & DIGITAL USE POLICY — STRICT USE

All online courses, digital materials, and training content provided by Niim Beauty Academy are licensed, not sold.

By purchasing or accessing any digital content, you are granted a limited, personal, non-exclusive, non-transferable, and revocable license for your individual educational use only.

5.1 Permitted Use

You may:

• Access the materials for your personal learning

• Apply the knowledge in your own professional practice

No other rights are granted.

5.2 Strict Prohibitions

You expressly agree that you will NOT, under any circumstances:

• Share, transfer, sell, sublicense, or distribute your login credentials

• Allow multiple users to access a single account

• Copy, reproduce, record, screenshot, download, or store course content (unless explicitly permitted)

• Upload Niim materials to social media, cloud drives, forums, or groups

• Resell or commercially exploit any portion of the training

• Create competing courses derived from Niim content

• Teach the Niim methodology without prior written authorization

• Use the content for school, team, or group training

These restrictions apply whether use is free or paid.

5.3 Monitoring and Enforcement

Niim reserves the right to monitor platform usage and investigate suspicious activity. Access may be restricted or terminated without prior notice where misuse is suspected.

5.4 Breach and Remedies

Violation of this section will result in enforcement actions which may include:

• Immediate termination of access

• Permanent account suspension

• Revocation of certificates

• Refusal of future services

• Legal action for damages and injunctive relief

You acknowledge that unauthorized use may cause irreparable harm to Niim.

6. INTELLECTUAL PROPERTY — FULL PROTECTION

All content and proprietary systems of Niim Beauty Academy are protected by copyright, trademark, trade secret, and other applicable laws.

6.1 Ownership

Niim retains full and exclusive ownership of all intellectual property, including but not limited to:

• Course videos and recordings

• Workbooks and guides

• Slide decks and frameworks

• The Niim Standard methodology

• Nail workflows and systems

• Visual assets and branding

• Website content and layout

• Curriculum structure

No ownership rights are transferred to you.

6.2 No Implied Rights

Except for the limited license expressly granted, no rights are granted by implication or otherwise.

6.3 Prohibited Intellectual Property Use

Without prior written consent, you may NOT:

• Reproduce or duplicate materials

• Modify or create derivative works

• Rebrand Niim methods as your own

• Use Niim content in your own training

• Share materials with third parties

• Use Niim branding for commercial gain

6.4 Injunctive Relief

You agree that any breach of Niim’s intellectual property rights may result in immediate legal action, including injunctive relief, damages, and recovery of legal costs to the maximum extent permitted by law.

7. STUDENT & CLIENT RESPONSIBILITY

Results vary by individual. Niim does not guarantee specific income, business success, or speed of skill mastery. Outcomes depend on the student’s effort, consistency, and market conditions.

8. HEALTH & SAFETY

Clients and students must disclose any relevant medical conditions, allergies, infections, or sensitivities.

Niim reserves the right to refuse service or training participation where safety or results may be compromised.

9. MEDIA RELEASE

Niim may photograph or record client results and training sessions for educational and marketing purposes.

Written notice must be provided in advance if you do not consent.

10. PROFESSIONAL CONDUCT

Niim maintains a professional learning environment and reserves the right to refuse or terminate service to anyone who is disruptive, unsafe, or in violation of policies. No refunds will be issued in such cases.

11. DISCLAIMER & LIMITATION OF LIABILITY

All Services are provided “as is” and “as available.” To the fullest extent permitted by law, Niim Beauty Academy shall not be liable for any indirect or consequential damages arising from use of the Site or Services.

12. GOVERNING LAW

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes shall be submitted to the courts of Quebec.

13. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
